Elon Musk just walked into a federal courtroom to prove that you can, in fact, sue people for evolving past you. The billionaire tech mogul testified Tuesday to argue that OpenAI stole a charity, which is a remarkably bold claim for a man who currently runs a direct competitor.

If Musk actually wins, the shockwaves will forcibly remodel the AI industry into a giant, nonprofit bake sale. We are talking about hundreds of billions of dollars in damages being handed back to a charitable arm, effectively making philanthropy the most lucrative racket in Silicon Valley.

The core of Musk’s legal argument is delightfully simple: it is apparently not okay to steal a charity. He co-founded the lab in 2015, dropped off a mere $38 million, and left in 2018 to go build spaceships and electric cars.

Now, he wants the current leadership fired, the corporate structure dismantled, and a mountain of cash delivered to the original cause. OpenAI’s lawyers naturally painted a slightly different portrait of the plaintiff.

They introduced the jury to a “tale of two Elons,” suggesting the plaintiff is driven less by humanitarian duty and more by the sheer agony of missing out. Microsoft’s attorney noted Musk’s sudden distaste for capitalism magically appeared right after ChatGPT became a global sensation.

The judge had to step in like a principal separating feuding freshmen, specifically warning both Musk and Altman to keep their hands off the keyboard. She explicitly told them to control their propensity to make things worse outside the courtroom.

Musk, displaying the accountability of a cat knocking a glass off a table, blamed the other side for starting the social media spat. This defense was slightly undermined by his Monday night post calling Altman “Scam,” but who are we to quibble over timestamps?
